Terms of Service

These Terms of Service ("Terms") govern your access to and use of MyElsewhen (the "Service"), operated by Andrew Gorshkov (registered as a sole proprietor in the Russian Federation, OGRNIP 324911200101194). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Geographic Availability

The Service is not available to residents of the Russian Federation. Users must reside outside the Russian Federation. By creating an account, you confirm that you do not reside in the Russian Federation.

We do not market, target, or knowingly accept registrations from users located in the Russian Federation. Accounts identified as belonging to Russian residents may be suspended.

2. The Service

The Service generates personalized historical fiction. After completing a questionnaire, you receive a character whose traits are shaped by your answers, living in a historical era you select. The character's life unfolds chapter by chapter over weeks or months of reading.

What the Service is:

• A literary fiction product with personalized characters.
• Entertainment.

What the Service is not:

• Not psychological help, therapy, or counseling.
• Not a spiritual practice, religious experience, or guidance system.
• Not a prediction, divination, or interpretation of your past, present, or future.
• Not medical, legal, financial, or professional advice of any kind.
• Not a substitute for human relationships or community.

The character is inspired by elements of your profile but is not you. The character's life is fictional. Events depicted are not predictions or recommendations about your real life.

3. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you confirm that you are of legal age in your jurisdiction (and in any case at least 18).

We collect your date of birth at registration to verify age. Accounts identified as belonging to users under 18 will be suspended and deleted.

4. Account

You are responsible for keeping your account credentials secure. You must provide accurate registration information and notify us promptly of any unauthorized use.

You may not create multiple accounts to circumvent limits, share your account with others, or transfer your account to another person.

We may suspend or terminate accounts that violate these Terms, including for repeated misuse, suspected automated access, attempted fraud, or behavior that exceeds reasonable use of the Service.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to access the Service through automated means, scrape content, or interfere with its operation.
• Reverse engineer, decompile, or attempt to extract the prompts, models, or systems behind the Service.
• Submit content (in open-text questionnaire fields or elsewhere) that is illegal, threatening, hateful, or that violates the rights of others.
• Resell, redistribute, or commercially exploit chapters generated for you.
• Attempt to bypass age verification, payment requirements, or usage limits.

6. Generated Content

6.1 Ownership

Chapters generated for you are made available to you for personal, non-commercial reading. You receive a personal, non-transferable license to read, save, and print chapters for your own use.

You may quote brief excerpts from your generated chapters publicly (for example, on social media), provided you do not claim authorship of the chapters as your own original creation. You may not republish entire chapters or sell them.

We retain the right to use anonymized, aggregated information about generated content to improve the Service.

6.2 Nature of generation

The Service uses artificial intelligence systems to generate fiction. Generated content is fictional. Any resemblance to real persons, living or dead, or to actual events, is coincidental, except where the Service deliberately places the character in a real historical period — in which case the historical setting is stylized and events involving real historical figures are fictionalized.

We make no warranty that generated content will be:

• Free of errors or inaccuracies.
• Historically precise.
• Consistent across all chapters.
• Satisfying or aligned with your expectations.

6.3 Sensitive content

You may exclude certain themes from your stories during onboarding. We make reasonable efforts to honor these exclusions, but cannot guarantee complete absence of all referenced themes. If you encounter content that distresses you, you may contact us for assistance.

7. Payments

7.1 Chapter packs and access plans

Some Service features require payment. We currently offer chapter packs (one-time purchases) and access plans (one-time 30-day purchases). Prices are displayed on the pricing page and may change with notice.

Payments are processed by Robokassa. By making a purchase, you agree to Robokassa's terms and your payment data is handled according to their privacy policy.

7.2 Access plans

The Service offers several access plans (Basic, Premium, Patron). Each plan is a one-time purchase that grants access to the Service for a fixed period of 30 days from the date of purchase and includes a plan-specific allotment of chapter credits. There is no auto-renewal and no recurring billing. When the 30-day period ends, plan-tier features stop. All previously generated content (chapters, stories, exported books) remains accessible indefinitely. No user data is deleted when an access plan expires.

To continue using plan-tier features after the period ends, you must make a new purchase. Plan details and current prices are listed on the pricing page.

7.3 Credits and limits

Chapter pack credits expire one (1) year from the date of purchase. Credits granted with an access plan expire when the 30-day plan period ends. When you have both plan credits and chapter pack credits available, plan credits are consumed first; chapter pack credits are consumed only after the plan allotment is fully used. The one-year expiration period of chapter pack credits runs independently of any active access plan. Credits cannot be transferred to other users or refunded for cash.

7.4 Refunds

Due to the digital, personalized, and immediately-delivered nature of the Service, all sales are final. We do not offer refunds for chapter packs or for access plans once the access has been activated.

Exceptions:

• Technical failures preventing access to purchased content for more than 7 days.
• Erroneous double charges.
• Other cases at our sole discretion.

To request a refund in an exceptional case, contact us within 14 days of the purchase.

7.5 Failed generations

If a chapter generation fails due to a technical error on our side, no credits are consumed and you may retry without cost.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes what data we collect and how we process it.

You consent at registration to the processing of your questionnaire data (temperament, values, current state, theme preferences) for the sole purpose of generating personalized fiction. You may delete all your data at any time through your account settings.

9. Service Availability

We provide the Service on an "as is" basis. We do not guarantee:

• Uninterrupted availability.
• Specific generation speed.
• Indefinite preservation of generated chapters.

We will make reasonable efforts to preserve your data and notify you in advance of significant service changes, but we may modify, suspend, or discontinue parts of the Service at our discretion.

10. Mental Health and Wellbeing

The Service is designed for entertainment. It is not equipped to address mental health crises, and the character in the story is fictional and is not a confidant, therapist, or source of guidance.

If you are experiencing emotional distress, suicidal thoughts, or a mental health crisis, please seek help from qualified professionals.

We are not responsible for emotional reactions to fictional content. By using the Service you acknowledge that fiction may evoke strong feelings and that you are responsible for your own wellbeing while reading.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is", without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service.
• Our total liability to you for any claim arising from or relating to the Service is limited to the amount you have paid us in the twelve months preceding the claim, or USD 50, whichever is greater.

These limitations apply to the fullest extent permitted by law and do not limit liability where such limitation is prohibited (for example, under applicable consumer protection law).

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from your violation of these Terms or your misuse of the Service.

13. Termination

You may delete your account at any time through account settings.

We may suspend or terminate your account for violation of these Terms, suspected fraud, or non-payment. We will give you reasonable notice except where immediate suspension is necessary to protect the Service or other users.

On termination, your data is deleted according to our Privacy Policy. Purchased credits are not refunded on termination for cause.

14. Dispute Resolution

Before initiating any legal proceeding, you agree to first contact us and allow 30 days for good-faith resolution.

EU consumers: Nothing in these Terms limits the consumer protections you have under the laws of your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms. Material changes will be communicated by email or in-product notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
